These Terms of Service ("Terms") govern your use of the Riverwell website and online store (the "Site"). Riverwell is a brand operated by Media Magma LLC, 30 N Gould Street, Suite R, Sheridan, WY 82801, United States ("Riverwell", "we", "us", "our").
By accessing, browsing, or placing an order on the Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not accept these Terms in their entirety, you are not authorized to use the Site or purchase any product.
You represent that you are at least 18 years old and legally capable of entering into a binding contract. You agree to use the Site only for lawful purposes and in accordance with these Terms.
Our Privacy Policy governs how we collect, use and protect your personal information.
If you send us photos of your throat in connection with our money-back guarantee, or describe symptoms or health conditions when contacting us, that information is consumer health data and is governed by our separate Consumer Health Data Privacy Policy. Those photos are used solely to process your claim. They are never used for marketing, never published, and never sold. See section 19.2.

All products are intended for personal use only. We may cancel orders that appear to be placed by resellers or distributors, and our money-back guarantee does not apply to bulk or wholesale purchases.
Riverwell products are cosmetic oral care products. They are not medical devices, and they are not intended to diagnose, treat, cure or prevent any disease or condition. These statements have not been evaluated by the Food and Drug Administration.
Riverwell products are intended for adults. Individual results vary. If your symptoms are severe, painful or persistent, or if you have any doubt about your health, consult a qualified healthcare professional. Nothing on the Site is medical advice, and nothing on the Site should be used as a substitute for professional medical care.
We may modify the Site, our products and our prices at any time without prior notice. Price changes do not apply to orders already placed and confirmed.
All prices are displayed in US Dollars (USD). You confirm that the payment method you use is valid and that you are authorized to use it. We may cancel or refuse any order where payment cannot be verified.
We may decline or cancel any order at our discretion, including where we suspect fraud, abuse of our policies, or resale.
We currently sell one-time purchases only. We do not operate subscriptions and we do not auto-renew any charge. If we introduce a subscription in the future, its terms, price and cancellation process will be disclosed to you clearly before you are charged, and you will be asked to consent to them separately.
We ship within the United States. You are responsible for providing an accurate and complete shipping address and for tracking your delivery. Delivery times are estimates and are not guaranteed.
If a package is lost or damaged in transit through no fault of yours, contact us and we will reship or refund your order — see our Return & Refund Policy.
If a delivery fails because of an incorrect or incomplete address, a failure to collect the package, or an unjustified refusal of delivery, the terms of our Return & Refund Policy apply: we reship the same product at your cost, and we handle any carrier claim ourselves.
We offer a 60-day money-back guarantee on first orders of the Riverwell Tonsil Stone Cleaner, purchased on useriverwell.com.
This guarantee requires a "before" photo of your throat, taken before your first use, and an "after" photo taken at the time of your claim. It is limited to one refund per customer, household and delivery address. Full conditions, including how your photos are handled, are set out in our Return & Refund Policy and our Consumer Health Data Privacy Policy.
Unopened products may be returned within 60 days of delivery, subject to prior authorization. Opened products cannot be physically returned for reasons of hygiene and product safety — the money-back guarantee in section 11 covers you instead, and requires no return.

Content posted by users on our social media channels does not reflect our opinions or positions. We may remove or block any content at our discretion.
Except where prohibited by law, the Site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you.
Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law.
To the fullest extent permitted by law, Riverwell and Media Magma LLC are not liable for indirect, incidental, special, consequential or punitive damages. Our total liability for any claim is limited to the amount you paid for the order concerned.
Nothing in this section limits liability for fraud, willful misconduct, personal injury caused by our negligence, or any liability that cannot be limited under applicable law.
Please read this section carefully. It affects your legal rights.
16.1 — Informal resolution first. Before starting arbitration, you agree to contact us at contact@useriverwell.com and give us 60 days to resolve your complaint informally.
16.2 — Binding arbitration. If we cannot resolve your complaint, any dispute arising out of or relating to these Terms, the Site, or our products will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be governed by the Federal Arbitration Act. Arbitration will take place in your county of residence, or by telephone or video conference if you prefer, or in Sheridan County, Wyoming.
16.3 — Class action waiver. You and Riverwell agree that any dispute will be brought individually only, and not as a plaintiff or class member in any class, consolidated or representative action. You waive your right to a jury trial. If this class action waiver is found unenforceable, then this entire section 16 is void.
16.4 — Small claims. Either party may bring an individual claim in small claims court instead of arbitration.
16.5 — Opt-out. You may opt out of this arbitration agreement by emailing contact@useriverwell.com within 30 days of your first purchase, with your name, order number, and a statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms, and we will not treat you any differently for doing so.
16.6 — Governing law. These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules, except where the law of your state of residence provides you with mandatory protections that cannot be waived.
You agree to indemnify and hold harmless Media Magma LLC, its officers, directors, employees and agents from any claim, damage, loss or expense arising from your misuse of the Site or your violation of these Terms.
We are not responsible for the content or practices of third-party websites accessible from the Site.
19.1 — Content you choose to publish. If you post a review, a testimonial, a comment, a photo or any other content on our Site or on our social media channels, you grant Riverwell a non-exclusive, royalty-free, worldwide, perpetual license to reproduce, display and use that content for marketing and promotional purposes. You confirm that the content is your own, that it is truthful, and that you have the right to grant this license. You may ask us to stop using your content at any time by emailing contact@useriverwell.com, and we will remove it from any material we control going forward.
19.2 — Content you send us privately. This license does not apply to anything you send us in the course of a support request, a return, or a money-back guarantee claim — in particular the "before" and "after" photos of your throat. Those photos are consumer health data. They are used solely to process your claim, are never used for marketing, advertising or publication, are never sold, and are deleted within 30 days of your claim being closed. See our Consumer Health Data Privacy Policy.
19.3 — No incentivized reviews. We do not condition our money-back guarantee, discounts or any other benefit on you writing a positive review, and we do not publish reviews that we know to be false or that were not written by a genuine customer.
All content on the Site — text, images, logos, product names and design — is owned by Media Magma LLC or its licensors and may not be used without permission.
To report a copyright infringement, email contact@useriverwell.com with: your contact information, a description of the work concerned, the URL of the alleged infringement, a statement made in good faith, and your signature.
By using the Site, you consent to receive communications from us electronically, including emails and notifications relating to your account and orders.
You may not assign your rights under these Terms. We may assign ours without restriction.
Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
We may terminate your access to the Site in the event of a violation of these Terms. Sections 14, 15, 16, 17 and 19 survive termination.
These Terms, together with our Privacy Policy, our Consumer Health Data Privacy Policy, our Return & Refund Policy and our Shipping Policy, constitute the entire agreement between you and Riverwell.
